Case Study - Charity's responsible persons to be suitable persons
Love to Learn is a registered charity with the purpose of advancing education, which was originally set up by a number of parents whose children went to school together. At the time of registration, each of the directors signed a declaration stating that they were not disqualified persons and would notify Love to Learn if their circumstances changed.
One of the board members, Jim, was recently disqualified by ASIC from being a director of a corporation but does not advise Love to Learn.
However, Love to Learn's secretary carries out a quarterly search of the ASIC Banned & Disqualified register in respect of each of the board members as part of her usual procedure and discovers that Jim has been disqualified by ASIC. Jim is asked to resign.
It is likely that in this instance the Charity would be found to have complied with Governance Standard 4.
